Director, Business Affairs

The Director, Business Affairs (DBA) creates value for the organization by negotiating best income results for the company relating to troubled retailers, including those in bankruptcy, and representing the company in any retailer litigations or disputes. The position is at the leading edge - acting front and center with what is happening in retail today and helping navigate the company to the best financial outcomes. The DBA works in partnership with the Senior Operating Managers (SOM), Operating Managers (OM), Leasing, Legal and other internal teams.
Contribute to the strategy and execute the actions as defined in the 5-Year Business Plan.
Analyze and negotiate all multi-store rent relief amendments and kick-outs.
Drive action and decision-making through rent relief and eviction proceedings, reducing portfolio accounts receivable.
Analyze and negotiate all retailer restructuring, terminations and settlement agreements.
Represent company in multi-store retailer litigation and disputes.
Develop strong relationships with third-party restructuring firms and retailer representatives.
Determine multi-store rent relief budget and maintain quarterly forecast.
Review year-end real estate adjustments in relation to amendment activity in prior year.
Work with SOM team in relation to any national retailer gross sales audits.
Provide oversight and guidance to Leasing and OM relating to accounts receivable strategy, rent relief determination, and terminations.
Develop and train OM staff on best practices to maximize long term returns and minimize income exposure.
Prepare summaries of negotiation strategy and potential outcomes for review and present to Senior Executive team for approval.
Develop understanding of tenant health and provide proactive advice to Leasing and OM about pre-leasing related to troubled tenants and minimizing exposure.
Understand industry trends and different markets in which our assets are located.

Real Estate Negotiation/Experience
Negotiating expertise must represent a broad range of knowledge and skills including:
o Economic deal structure and deal investment return to the owner
o General knowledge of lease provisions and clauses
o Ability to resolve internal and external deal issues
o Strong oral, written, and listening skills
Demonstrate a strong financial acumen, including knowledge of accounting principles, budgeting & forecasting, NPV and IRR calculation
Demonstrate strong understanding of retailer balance sheets and income statement
5 years of related experience in office/shopping center/retailer roles
Demonstrated knowledge and interest in commercial real estate.
B.A. or B.S. degree in Business with emphasis in Finance or Accounting preferred

Don't Be Fooled

The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
